General information

These General Conditions of Sale have as their subject the purchase of products made remotely via computer network on the site www.haberi.it, belonging to HABERI HAUTE COUTURE Snc of Emiliana Haberi with registered office in Rome (RM), Via D’Ascanio, 17. Each purchase operation will be regulated by the provisions of Legislative Decree no. 185/99, Legislative Decree no. 206/05; the information required for the conclusion of the contract will be subject to art. 12 of Legislative Decree no. 70/03 and, as regards the protection of confidentiality, will be subject to the regulations of Legislative Decree no. 196/03.

The purchase contracts will be deemed finalized when the customer sends the purchase order through the site www.haberi.it to HABERI HAUTE COUTURE Snc of Emiliana Haberi and the latter will promptly send the customer receipt of the purchase order made by the customer.

By sending the purchase order electronically, the customer declares to have read and accepted the present conditions of contract and undertakes to observe and respect them in his/her relations with HABERI HAUTE COUTURE Snc di Emiliana Haberi.

Personal data processing

HABERI HAUTE COUTURE Snc di Emiliana Haberi, in accordance with art. 13 of Legislative Decree 196/2003, hereby informs you that personal and accounting data acquired also verbally in reference to the commercial relations established, provided directly by the interested parties, or otherwise acquired within the scope of the company’s activity, will be processed in compliance with the aforementioned legislation, including the confidentiality obligations envisaged by the latter. In relation to the above, the rights referred to in Article 7 of Legislative Decree 196/2003 may be exercised.

Customer’s obligations

The customer is obliged, before sending his/her purchase order, to read carefully these general conditions of sale. The forwarding of the purchase order implies their full knowledge and acceptance. Finally, once the online purchase procedure has been completed, the Customer is required to print and keep these general conditions of contract, which have already been viewed and accepted during the conclusion phase of the contract.

Sales prices

The prices indicated on the website www.haberi.it are inclusive of VAT and all other taxes, with the exception of those in which it is otherwise indicated.

Delivery of products: timing, costs and modalities

The seller HABERI HAUTE COUTURE Snc of Emiliana Haberi undertakes to book the courier for delivery only upon receiving payment. The shipment is made via express courier and the delivery time on Italian soil is 1-4 working days, depending on the shipping method selected. However, these delivery times are to be considered as indicative, as any delays are solely attributable to the courier and the seller HABERI HAUTE COUTURE Snc of Emiliana Haberi is not in any way responsible.

During the period of sales or promotions and during the Christmas holidays, shipments may be delayed.

In case of failed delivery due to absence of the recipient at the address indicated in the order, the courier will leave a notice and try again a second time. If the recipient is still absent, the courier will leave a notice for the collection of the package at the post office of reference, where it will remain in stock for a further 7 working days. Finally, after these 7 working days the package will be returned to HABERI HAUTE COUTURE Snc of Emiliana Haberi.

In the event that the package is delivered with any damage to the packaging, the customer consumer must indicate on the delivery receipt of the courier “accepted with reservation”. You will also be asked to email sartorial@haberi.it specifying the nature of the damage to the packaging and any products contained.

Right to withdraw

The products purchased on the site www.haberi.it are regulated by the Consumer Code (art. 52 of Legislative Decree 206/2005 as amended by Legislative Decree 21/2014) and therefore the customer may exercise the right of withdrawal within 14 days of receipt of goods. Within this period, the customer must send a registered letter with return receipt to HABERI HAUTE COUTURE Snc di Emiliana Haberi, Via D’Ascanio, 17, 00186 Roma. In this registered letter must be indicated the request for withdrawal duly signed. The refund will be made on the same vehicle used for the purchase. The request for withdrawal must be anticipated by email to sartorial@haberi.it.

The customer is required to send the goods, by traceable shipping, and pack it in a manner that ensures its integrity during transport. The cost of returning the goods shall be borne by the customer. The goods must always be returned within 14 days from the date of receipt of the same.

The refund of the price of the goods will take place as soon as possible and in any case no later than 30 days from receipt of the registered letter with which the will to return the goods has been expressed.

HABERI HAUTE COUTURE Snc di Emiliana Haberi reserves the right to assess the integrity of the returned goods and in case of damage, any repair costs will be deducted from the amount to be refunded.
In the event that the provisions for the right of withdrawal set out herein are not respected or the goods are irreversibly damaged, the customer will not be entitled to a refund of the sums paid. The customer, in this case, may request the shipment at his own expense of the goods, if they have already been returned to HABERI HAUTE COUTURE Snc of Emiliana Haberi and get the products back in the state in which they were returned to the seller.

Warranty

The products on the website www.haberi.it are subject to the warranties provided by the legislation in force at the time of purchase. HABERI HAUTE COUTURE Snc di Emiliana Haberi is liable to the customer for any conformity fault at the time of delivery of the goods, provided that the goods have been used correctly and not damaged due to the negligence of the customer. The return of the goods must be made to this address: HABERI HAUTE COUTURE Snc by Emiliana Haberi, Via D’Ascanio, 17, 00186 Roma.
HABERI HAUTE COUTURE Snc di Emiliana Haberi reserves the right to assess the actual defect of the goods and then provide for repair or replacement of the same.
The costs for the return of the goods are to be considered at the expense of the customer.
